By registering, starting a trial, authorising recurring payment, purchasing a plan, publishing a store or otherwise using WAKART, you agree to these Terms.
1. Acceptance and eligibility
These Terms and Conditions (“Terms”) govern access to and use of the WAKART website, seller dashboard, hosted storefronts, subscription services and related tools (“Services”). “Merchant”, “you” and “your” refer to the person or business using the Services. “WAKART”, “we”, “us” and “our” refer to WAKART.
You must be legally capable of entering into a binding contract and, where you act for a business, authorised to bind that business. Information provided during registration, verification, billing and store setup must be accurate and kept current.
2. Platform services
WAKART provides software that enables merchants to create and manage an online storefront, publish products or services, share store links, receive structured enquiries or orders through WhatsApp, and use features included in the selected plan.
WAKART is a technology platform. Unless expressly stated otherwise, WAKART is not the seller, manufacturer, distributor, delivery provider or payment recipient for products and services offered by individual merchants to their customers.
3. Accounts, verification and security
- You are responsible for safeguarding the email account, mobile device and other credentials used to access WAKART.
- OTP codes and account access must not be shared with unauthorised persons.
- You must notify us promptly if you suspect unauthorised access, fraud or misuse.
- We may request identity, business, tax, bank or compliance documents before activating or continuing certain features.
- Duplicate, misleading, fraudulent or unverifiable registrations may be rejected or restricted.
4. Trials, plans and subscriptions
Plan price, billing cycle, trial duration, product limit, user limit, image limit, subdomain entitlement and other features are those displayed at the time of selection or assigned through an authorised WAKART administrator.
- A free trial provides temporary access for the stated period and may require a separate AutoPay or recurring-payment authorisation.
- Unless cancelled before the renewal date, an authorised recurring subscription may be charged automatically according to the selected billing cycle.
- Subscription fees are normally collected in advance. Applicable taxes may be added.
- Cancellation stops future renewal; it does not normally create a refund for the current paid period.
- When a trial or subscription expires, access to the storefront, dashboard or selected features may be limited or suspended.
- Plan upgrades, downgrades and future price changes may be subject to additional rules shown at the time of the change.
Refund eligibility is governed by the Cancellation and Refund Policy.
5. Payments, Razorpay and AutoPay
WAKART may use Razorpay or another authorised payment service provider to collect subscription charges, verify payment instruments, create recurring mandates and process refunds. Payment details entered on the provider’s checkout are also governed by that provider’s terms and privacy policy.
You authorise charges only when you complete the relevant checkout or mandate process. You are responsible for ensuring sufficient funds and valid payment information. A failed, reversed, disputed or overdue payment may result in restricted access, retry attempts permitted by the payment network, or suspension of the subscription.
Payment references, status, amount, method and limited billing metadata may be stored for accounting, support, fraud prevention and dispute handling. WAKART does not require merchants to provide full card numbers, CVV or banking passwords directly to WAKART.
6. Merchant responsibilities
You remain fully responsible for your store and business, including:
- the accuracy, legality, quality, safety, pricing and availability of every listing;
- licences, registrations, taxes, invoices, warranties and regulatory compliance;
- customer communication, order confirmation, fulfilment, delivery and after-sales service;
- your own customer cancellation, return, replacement and refund obligations;
- obtaining lawful permission to upload product images, trademarks, descriptions and other content;
- providing appropriate privacy notices and protecting customer information collected through your store.
You must not represent that WAKART guarantees, endorses or is the seller of your products or services.
7. Acceptable use and prohibited activity
You must use WAKART only for lawful business purposes. You must not list, promote, facilitate or sell illegal, counterfeit, stolen, unsafe, fraudulent or restricted goods or services, or use the platform for deceptive, abusive or harmful conduct.
Prohibited technical activity includes malware distribution, phishing, unauthorised vulnerability testing, credential theft, bypassing plan limits, scraping that disrupts the service, reverse engineering where prohibited by law, or attempting to access another user’s account or data.
We may remove content, request proof of compliance, restrict a store, or report suspected unlawful conduct to payment providers or competent authorities where reasonably necessary.
8. Intellectual property
You retain ownership of content you lawfully upload. You grant WAKART a limited, non-exclusive licence to host, copy, resize, display and process that content only as reasonably necessary to provide, secure, support and improve the Services.
WAKART’s software, design system, brand, documentation and platform content remain the property of WAKART or its licensors. No ownership is transferred to you.
9. Availability, maintenance and changes
We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability. Maintenance, hosting failures, internet outages, third-party services, security incidents, force majeure events or changes required by law may affect access.
Features may be improved, replaced, limited or discontinued. We will make reasonable efforts to communicate material changes that significantly affect an active paid service.
10. Suspension and termination
We may restrict, suspend or terminate access for non-payment, material breach, prohibited products, fraud, security risk, abusive behaviour, legal requirements or activity that may harm customers, merchants, WAKART or third parties. Serious violations may require immediate action without advance notice.
You may stop using the service and cancel future renewal. Expiry, cancellation or termination may limit access to stored data. You should export information you are legally entitled to retain before access ends.
11. Disclaimers and limitation of liability
To the maximum extent permitted by applicable law, WAKART does not guarantee sales, revenue, customer demand, search ranking, payment approval, uninterrupted third-party services or the conduct of merchants or customers.
WAKART is not responsible for merchant products, customer disputes, delivery failures, regulatory violations, tax obligations or indirect, incidental, special or consequential losses. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.
12. Governing law and disputes
These Terms are governed by the laws of India. The parties should first attempt to resolve a dispute through good-faith written communication. Subject to mandatory law, unresolved disputes will be handled by courts having jurisdiction over the registered place of business of WAKART.
If any provision is held unenforceable, the remaining provisions continue in effect. Failure to enforce a provision immediately does not waive the right to enforce it later.
13. Changes to these Terms
We may update these Terms to reflect feature, legal, security or business changes. The revised date will be shown on this page. Where renewed consent is legally or operationally required, access to affected features may depend on accepting the updated Terms.
